The decision of ICJ in the matter of Kulbhushan Yadav have disturbed Pakistan.
On Thursday, it again claimed to catch an Indian spy. Pakistan police say they caught a detective from the city of Dera Ghazi Khan (DG Khan) in the province of Punjab. And, that detective has accepted the fact that he is an Indian.
According to Pakistan Media Reports, the alleged detective name is Raju Lakshman. The police caught him on Wednesday in Rakhi Gaj area of DG Khan, 400 km from Lahore.
Police say that Laxman was trying to come from Balochistan province to DG Khan. At present, they have taken him to the secret place for further investigation.
PAKISTAN HAD SAID – JADHAV WAS NOT A BUSINESSMAN, BUT A SPY.
Earlier, Pakistan said that his army had arrested Kulbhushan Jadhav on 3rd March 2016 from Balochistan.
He had entered Iran from Pakistan. Pakistan claimed that Indian Navy officer Jadhav is not a businessman but a spy.
However, India had submitted evidence and claimed that Pakistan had kidnapped Jadhav from Iran. Jadhav was trying to do business after retiring from the Navy there.
THE ICJ HAD SUSPENDED THE DEATH SENTENCE OF KULBHUSHAN JADHAV
The International Court (ICJ) had ruled in favor of India last month in connection with the hanging of Indian citizen Kulbhushan Jadhav by Pakistan’s military court. The 16 judges of the court suspended the hanging sentence of Kulbhushan with a majority of 15-1. Court President Justice Abdulqawi Ahmed Yusuf said that unless Pakistan reviews and reconsiders the matter the hanging will continue.
PAKISTAN VIOLATED THE VIENNA TREATY- ICJ
Judge Abdulqawi Ahmed Yusuf, Court President, Somalia, had said in a 42-page verdict that unless Pakistan has reviewed and reconsidered its decision, Kulbhushan Jadhav’s execution will be suspended.
ICJ said – Pakistan has sidelined the right of India’s dialogue and the access to the consular access with Kulbhushan. It did not give India the chance to provide a legal representative for Kulbhushan. It violated the Conventional Relations rules under the Vienna Treaty.
The judges said – Pakistan has denied India the right to negotiate and meet with Kulbhushan Jadhav. India has appealed for concurrent access many times, which Pakistan has turned down. It is an undeniable fact that Pakistan did not accept India’s appeal.
“Pakistan had to provide information to India regarding the arrest and confinement of Kulbhushan under the Vienna Treaty. Pakistan has delayed the submission of information of Jadhav’s arrest, which also violates the terms of the Vienna Treaty. It has not clarified that because of any disturbance of India, he has stopped himself from fulfilling the conditions of the treaty.
International legal advisor Rima Omer said: The court also said that Pakistan would reconsider its decision in relation to Article 36 (1) i.e. violation of the grant of concurrent access.
